From Wiktionary under the GNU Free Documentation License. A lease is a contract conferring a right on one person (called a tenant or lessee) to possess property belonging to another person (called a landlord or lessor) to the exclusion of the owner landlord, and all others except with the invitation of the tenant. It is a rental agreement between landlord and tenant. The relationship between the tenant and the landlord is called a tenancy, and the right to possession by the tenant is sometimes called a leasehold interest. A lease can be for a fixed period of time (called the term of the lease) but (depending on the terms of the lease) may be terminated sooner. The consideration for the lease is called rent or the rental. A lease should be contrasted to a license, which may entitle a person (called a licensee) to use property, but which is subject to termination at the will of the owner of the property (called the licensor). An example of a license is the relationship between a parking lot owner and a person who parks a vehicle in the parking lot. Under normal circumstances, owners of property are at liberty to do what they want with their property (for a lawful purpose), including dealing with it or handing over possession of the property to a tenant for a limited period of time. If an owner has surrendered possession to another (i.e., the tenant) then any interference with the quiet enjoyment of the property by the tenant in lawful possession is itself unlawful. Similar principles apply to real property as well as to personal property, though the terminology would be different. Similar principles apply to sub-leasing, that is the leasing by a tenant in possession to a sub-tenant. The right to sub-lease can be expressly prohibited by the main lease, sometimes referred to as a "master lease". From Wikipedia under the
GNU Free Documentation License What happens after you break an apartment lease? Q. I broke my lease 2 yrs ago. The lease was for 14 months. I completed 10/14. I had emergencies throughout my lease that caused me to not keep up the lease. I was struggling for 2-3 months after my unexpected emergenices. On my 11th month, I just left without making arrangements. I did surrender my keys and gave management my new address. I was billed 3k from the office and I decared bankruptcy on it. It was very stupid and now I am ready to have an apartment again I do have plenty of money saved just in case something happens again. What should I do and whay may possibly happen when I apply? Because you included the debt owed to the previous landlord as a part of your discharged debt from your bankruptcy, it should not be held against you for future rentals. Most all landlords will run your credit when you apply for an apartment and a recent bankruptcy isn't going to look good, but it might be a little better than an unresolved judgment against a deadbeat tenant. As a safeguard a landlord might require a larger deposit considering the risk of your recent behavior, or you could suggest it to change a "I won't rent to you" into a "when do you want to move in". Don't harp on the "emergencies" that you endured, but rather how much more financially stable… [cont.] Answered by linkus86 - Thu Nov 30 22:04:52 2006 How to break apartment lease for involuntary job transfer? Q. I am currently working in Chicago, Illinois. My employer is forcing me to work in New York, NY. I am 2 months into my 12 month apartment lease. Anyone know of an Illinois clause to break a leasing contract legally? Asked by sparky912 - Sat Apr 18 15:59:16 2009 - - 2 Answers - 0 Comments A. You will need to keep paying the lease until they release the unit. Try to help them find new tenants. Your employer should pay your extra cost if they are forcing a move. Your landlord has nothing to do with your job situation so don't need to lose money for your benefit. Q. My brother is renting an apartment that he signed a yrs lease for. He still has 8mos left on his lease. He is planning on moving with his girlfriend and breaking his lease. I tried to talk him out of it. I told him that he can and will be sued and must pay them at least 3months rent if he wants to leave. Did I advise him correctly? Asked by Kelly K - Thu Apr 2 20:19:13 2009 - - 6 Answers - 0 Comments A. Your brother has agreed to the terms of the lease. If it is a large apartment complex they are more likely to hold him to it than an individual owner. They can require that he pays the rent for the entire 8 months remaining. They are within their rights and it just depends if he has enough assets for them to pursue a court case against him. If he had any co-signers, they will also be responsible. They could also garner his wages if that is the only way to get their money. The best course of action would be to find someone else to sub-let to and ask the landlord to substitute their payments for the remaining term of the lease.
